End User License Agreement (EULA) and Terms of Service
SEA UP Games Last updated: 2026
This End User License Agreement and Terms of Service (the "Agreement") is a legal agreement between you and SEA UP Games ("SEA UP", "we", "us", "our"). It covers every game we publish, now or in the future, on any platform (the "Games"), our website at seaupgames.com, and our related services, events and community channels (together, the "Services").
By downloading, installing, accessing or playing a Game, or by using the Services, you agree to this Agreement and to our Privacy Policy. If you do not agree, do not use the Services.
1. Who provides the Games
SEA UP publishes the Games for players in Southeast Asia. Each Game is developed by a development partner (the "Developer"), who owns or licenses the Game's intellectual property and operates its servers. SEA UP is the publisher and your main point of contact for the Games we publish.
2. Who can use the Services
- You must be at least 13 years old to use the Services, or older if a Game's age rating requires it.
- If you are under 18, or under the age of adulthood where you live, you may use the Services only with the permission of a parent or guardian, who agrees to this Agreement on your behalf and is responsible for your use, including any purchases.
- You may not use the Services if the law in your country prohibits it, or if we have previously banned your account.
3. Your account
- You can play as a guest or link a Google, Apple or email account. Guest accounts can be lost if you delete the Game, reset your device or change devices. Link your account to keep your progress.
- You are responsible for keeping your login details safe and for everything that happens on your account.
- Your account is personal. You may not sell, buy, share, rent or transfer accounts.
- Tell us right away at hq@seaupgames.com if you think someone else is using your account.
4. License to play
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to download, install and play the Games for your own personal, non-commercial use, on devices you own or control, in line with this Agreement and the rules of the app store you downloaded the Game from.
The Games are licensed, not sold. All rights not expressly granted to you are reserved by SEA UP, the Developer and their licensors.
5. Rules of play
You agree not to:
- use cheats, hacks, bots, scripts, macros, emulators that automate play, or any unauthorised third-party software;
- exploit bugs or errors. If you find one, please report it to us;
- copy, modify, decompile, reverse engineer or disassemble a Game, or try to access its source code or servers without permission;
- interfere with or disrupt the Game, its servers or networks, or other players' enjoyment of the Game;
- sell, buy or trade accounts, virtual items or virtual currency for real money or anything of value outside the Game ("real-money trading");
- harass, threaten, abuse or impersonate others, or post content that is illegal, hateful, sexually explicit or otherwise inappropriate;
- use the Services for advertising, spam or any commercial purpose without our written permission; or
- break any law, or help anyone else do any of the above.
We may investigate suspected violations and take action under Section 12.
6. Virtual items and virtual currency
The Games may include virtual currency (such as gems or diamonds) and virtual items (such as heroes, equipment, avatar frames or other content) ("Virtual Items").
- Virtual Items are licensed to you for use in the Game only. You do not own them, and they have no real-world monetary value.
- Virtual Items cannot be exchanged for real money, goods or services from us or anyone else, and cannot be transferred to another account.
- We may manage, change, rebalance or remove Virtual Items, for example to keep the Game fair, fix bugs or update gameplay, without liability to you, except where the law requires otherwise.
- If your account is suspended or terminated for breaking this Agreement, you lose access to your Virtual Items.
7. Purchases
- In-game purchases are made through the app store you downloaded the Game from (such as the Google Play Store or the Apple App Store) or through an official payment partner we name on our website, and are subject to their terms and payment policies. We do not receive your payment card or bank details.
- Prices are shown in the store before you buy and may include taxes.
- All purchases are final once the Virtual Items are delivered, except where refunds are required by law or granted under the store's refund policy. Refund requests for app store purchases are handled by the store you bought from:
- Google Play: play.google.com/store/account/orderhistory
- Apple App Store: reportaproblem.apple.com
- If a purchased item does not arrive, contact us at hq@seaupgames.com with your player ID and the receipt or order number, and we will investigate.
- If a refund is granted for an item you have already received, we may remove that item, or an equivalent amount of Virtual Items, from your account.
- If you are under 18, you must have a parent or guardian's permission before making any purchase.
8. Gift codes, events and rewards
- We may give out gift codes, event rewards, tester rewards and other promotions. Each has its own conditions, such as expiry dates, use limits and eligible regions, which we announce with it.
- Gift codes have no cash value, cannot be sold, and may be cancelled if obtained or used against the rules.
- We may change or end any event or promotion at any time, but we will honour rewards you have already received, unless they were obtained by breaking this Agreement.
9. Test versions
We may invite you to test pre-release versions of a Game (closed tests, open tests or beta versions).
- Test versions are provided "as is". They may contain bugs, crashes, missing content and unbalanced gameplay, and they may change at any time.
- Progress, items and data from a test are usually wiped when the test ends or when the Game launches, unless we announce otherwise. Tester rewards are delivered as announced for that test.
- In-app purchases may be disabled during tests.
- Please do not share, copy or redistribute test builds, and please do not publish content from a test where we have asked you not to.
- Feedback you give during a test helps us improve the Game; see Section 10.
10. Your content and feedback
- You keep ownership of content you create, such as chat messages, screenshots, videos and posts ("User Content"). By sharing User Content in our Services or community channels, you give SEA UP and the Developer a free, worldwide, non-exclusive license to use, copy, display and share it in connection with the Games and their promotion. We will credit you where it is reasonable to do so.
- You may create videos, streams and screenshots of the Games for non-commercial or monetised channels (such as YouTube or TikTok), as long as you do not suggest that we endorse you, and you follow this Agreement. We may withdraw this permission for specific content that harms the Game or its community.
- If you send us ideas, suggestions or feedback, we may use them freely, without any obligation to you.
11. Updates, changes and closure
- We may update the Games at any time to add, change or remove features or content. Some updates may be required to keep playing.
- We may stop providing a Game in some or all countries. If we decide to close a Game, we will try to give at least 30 days' notice in the Game or on our website. Unused Virtual Items are not refundable when a Game closes, unless the law requires otherwise.
12. Suspension and termination
- If you break this Agreement, we may warn you, remove content, reset or remove Virtual Items obtained by breaking the rules, or temporarily or permanently suspend your account, depending on how serious the violation is.
- If you believe we made a mistake, contact us at hq@seaupgames.com and we will review the decision.
- You may stop using the Services and delete your account at any time (see our Privacy Policy).
- Sections 6, 10, 13, 14, 15 and 16 continue to apply after this Agreement ends.
13. Intellectual property
The Games and all their content, including characters, artwork, music, text, software, logos and trademarks, are owned by the Developer, SEA UP or their licensors, and are protected by copyright and other laws. Nothing in this Agreement gives you any ownership of them.
14. Disclaimers
To the extent allowed by law, the Services are provided "as is" and "as available". We do not promise that the Services will always be available, uninterrupted, free of errors or compatible with every device. Nothing in this Agreement limits any rights you have under consumer protection laws that cannot be excluded.
15. Limitation of liability
To the extent allowed by law:
- SEA UP and the Developer are not liable for indirect, incidental, special or consequential losses, or for loss of data, Virtual Items, profits or goodwill.
- Our total liability to you for any claim related to the Services is limited to the amount you paid us for the Services in the 6 months before the claim arose.
Nothing in this Agreement excludes liability that cannot be excluded by law, such as liability for fraud, gross negligence or wilful misconduct.
16. Governing law and disputes
This Agreement is governed by the laws of the Republic of Indonesia.
If you have a problem with the Services, please contact us first at hq@seaupgames.com. Most problems can be solved this way. If we cannot resolve a dispute informally within 30 days, it will be settled by the competent courts of the Republic of Indonesia, unless the consumer protection laws of your country give you the right to bring a claim in your local courts.
17. Additional terms for Apple App Store users
If you downloaded a Game from the Apple App Store, you also agree that:
- This Agreement is between you and SEA UP only, not Apple. SEA UP, not Apple, is responsible for the Game and its content.
- Apple has no obligation to provide maintenance or support for the Game.
- If the Game fails to meet any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) of the Game. To the maximum extent permitted by law, Apple has no other warranty obligation for the Game.
- SEA UP, not Apple, is responsible for handling any claims relating to the Game, including product liability claims, claims that the Game fails to meet legal or regulatory requirements, and consumer protection claims.
- If anyone claims that the Game infringes their intellectual property rights, SEA UP, not Apple, is responsible for investigating and handling the claim.
- You confirm that you are not located in a country subject to a U.S. government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. government list of prohibited or restricted parties.
- You must follow any applicable third-party terms when using the Game.
- Apple and its subsidiaries are third-party beneficiaries of this Agreement and may enforce it against you.
18. Changes to this Agreement
We may update this Agreement from time to time. We will change the "Last updated" date above, and if the changes are significant, we will tell you in the Game or on our website before they take effect. If you keep using the Services after the changes take effect, you accept the updated Agreement.
